Murder convict freed following State withdrawal of his case

Narendra Kumar Chaudhary aka Pappu of Betahani VDC-1 was released from Banke Prison where he was serving a life sentence. Chaudhary, who was convicted of homicide and robbery, was released on February 26 following the same day’s District Court Banke Judge Haripratap KC’s approval of Dr. Baburam Bhattarai led government decision to withdraw his case. The cabinet decision of October 4, 2012, decided to withdraw his case. The government then wrote to the Office of the District Attorney through the Office of Attorney General asking it to implement the cabinet decision. As per the Section 29 of the State Cases Act 1992, the government cannot withdraw the case without the approval of the court. CPN-UML cadre Nau, 39, of Betahani VDC-3, was injured in beatings of NC cadres and died on April 1 while undergoing treatment at Lucknow of India after having primary treatment at Bheri Zonal Hospital. Nau was assaulted by NC cadres led by Chaudhary on April 12 following a dispute over the formation of the consumers' committee for constructing Betahani-Holiya Road on April 10. Nau received deep injuries on his head. Another injured in the same attack, Nau’s uncle Mansab Ali of Betahani VDC-3 also died on May 4, 2010, while undergoing treatment at Bheri Zonal Hospital. Police recovered one musket, home-made pistol, one khukuri, and four rounds of bullets. Nau’s elder brother Akub Ahamad Nau filed the FIR against Chaudhary and the other 14 people at District Police Office on May 5, 2010. The bench of Shekhar Poudel of Banke District Court convicted Chaudhary and other four of murder and sentenced them to life imprisonment on October 2, 2012.
