Kathmandu/May 11 Opening the way for challenging the disputed appointment of Lokman Singh Karki as the chief of the Commission for Investigation of Abuse of Authority (CIAA) in the court, the Supreme Court on May 10 asked its registrar to accept the writ petition against the appointment. A single bench of justice Ram Kumar Prasad Sah ordered the court administration to register the case. Advocate Om Prakash Aryal had challenged the SC registrar's refusal to register his writ against the recommendation to appoint Karki as the anti-graft agency chief. Karki was sworn in as CIAA chief on Wednesday amid protests of the civil society, student organizations and objection from some leaders of the Nepali Congress and CPN-UML. Earlier, Aryal had filed a writ petition urging the SC to stop the proceeding on the recommendation of Karki as CIAA chief made by four political parties. Rejecting the interim order of the SC, a division bench decided the political process could not be interfered and prejudged. Aryal’s attempt to stop the appointment of Karki was foiled when a verdict of the SC was invoked by the registrar asking Aryal to furnish the evidence and acknowledgement of Constitutional Council about impending writ petition. Vivek Dhungana काठमाडौँ । वैशाख २८ गते लोकमान सिंह कार्कीलाई अख्तियार प्रमुख बनाउने संवैधानिक परिषद्को निर्णय विरूद्ध पेश भएको रिट दर्ता हुने भएको छ । न्यायाधीश रामकुमारप्रसाद साहको ०७० वैशाख २७ गतेको एकल इजलासले सर्वोच्च प्रशासनको रिट दर्ता नगर्ने निर्णय बदर गरेपछि कार्की सिफारिसविरूद्धको रिट दर्ता हुने भएको हो । अधिवक्ता ओमप्रकाश अर्यालले जनआन्दोलनका दोषी तथा भष्ट्रचार अभियोग लागेका कार्कीलाई अख्तियार दुरूपयोग अनुसन्धान आयोगको प्रमुख आयुक्तमा नियुक्ति नगर्न भन्दै ०७० वैशाख २३ गते पेश गरेको रिट सर्वोच्च प्रशासनका रजिष्ट्रार लोहितचन्द्र शाहले तीन शर्त तेर्साएर फिर्ता गरिदिएका थिए । रजिष्ट्रार शाहले रिट निवदेकले विपक्षी निकायबाट नै कानूनी उपचार माग्नुपर्ने, त्यसमा चित्त नबुझे मुद्दा दायर गर्नु अघि विपक्षीलाई जानकारी गराउनुपर्ने र उक्त जानकारी गराएको प्रमाण अदालतमा पेश गरेमात्र रिट दर्ता हुने भनेका थिए । अधिवक्ता अर्यालले सार्वजानिक विषय रहेको कार्कीविरूद्धको रिट दर्ता नगर्ने रजिष्ट्रार शाह आदेश खारेजीको माग गरी निवदेन दर्ता गर्न पाऊँ भनी पुनः ०७० वैशाख २४ गते सर्वोच्चमा निवदेन दायर गरेका थिए । कार्कीको सिफारिसविरूद्द कार्यान्वयन नगराउने माग गर्दै सर्वोच्चमा रिट निवदेन पेश गरे पनि रिट दर्ता नहुँदै ०७० वैशाख २६ गते नै राष्ट्रपति रामवराण यादवले कार्कीलाई अख्तियार प्रमुखमा नियुक्त गराइसकेका छन् । विवेक ढुङ्गाना
