The Supreme Court (SC) has ordered arrest of Dr Govinda KC who has started his 14th fast-unto-death against the Supreme Court’s order to reinstate Prof Dr Shashi Sharma as dean of Institute of Medicine under the Tribhuvan University (TU). A single bench of Dambar Bahadur Shahi, hearing a contempt of court case against Dr KC on Monday, has ordered he be arrested and presented to the court on Tuesday. The senior orthopedic surgeon at Tribhuvan University Teaching Hospital (TUTH) earlier on Monday started the hunger strike by organizing a press conference. The joint bench of Chief Justice Gopal Parajuli and Justice Dipak Kumar Karki, after conducting the final hearing of the writ petition filed by Sharma four years ago demanding his reinstatement, had ordered his reinstatement for four days if he so wishes on Sunday. “I am staging the hunger strike against the chief justice,” Dr KC said in the press conference. This is the 14th time that Dr KC is staging the hunger strike. “Now our judiciary does not give justice, rather it sells it. It is now under the command of the group that punishes honest, and helps protect the corrupt and criminals. There is no alternative to fighting with the root of the problem in such situation created to cover up the judicial crime and to fulfill personal interests at a time when laws and rules should be followed. So there’s no alternative to fighting against corrupt and Mafia-guided only to save the judicial dignity,” Dr KC further said. सर्वोच्च अदालतले पक्राउ गरी पेश गर्न आदेश गरेपछि प्रहरीले डाक्टर गोविन्द केसीलाई पक्राउ गरेको छ। एसपी रामदत्त जोशी नेतृत्वको टोलीले उनलाई अनसनस्थलबाट पक्राउ गरेको हो। केसीलाई अाज राति सिहदरबार प्रहरी बृतमा राखिने काठमाडाैं प्रहरी प्रमुख एसएसपी रवीन्द्र धानुकले सेतोपाटीलाई बताए। अदालतको आदेशअनुसार केसीलाई भोलि बिहान ९ बजे सर्वोच्चमा उपस्थित गराइने उनले जानकारी दिए। केसीले प्रेस विज्ञप्तिमार्फत अदालतबाट भएको फैसलाविरुद्ध आमजनमानसमा भ्रम पर्ने गरी नेपालको न्याय व्यवस्था, न्यायपालिका र न्यायाधीशहरुका विरुद्ध अमर्यादित, अशिष्ट र अदालतको अवहेलनाजनक अभिव्यक्ति दिएको भन्दै उनलाई पक्रेर मंगलबार विहान ९ बजे अदालतमा दाखिल गर्न सोमबार सर्वोच्चले प्रहरीलाई आदेश दिएको थियो। सर्वोच्चको आदेशको केही घन्टाभित्रै प्रहरीले उनलाई पक्रेको हो। डाक्टर केसी प्रधानन्यायाधीश गोपाल पराजुलीको बर्खास्तगी लगायतका माग राखेर आज दिउँसोदेखि अनसन बसेका थिए। सर्वोच्चले आफैं टिप्पणी उठाएर इजलासमा पेश गरेको यो मुद्दामा डाक्टर केसीले अदालतको अवहेलना गरेको ठहरिए उनलाई के सजाय हुन सक्छ भन्ने धेरैको चासो छ। अदालतको अवहेलनामा हुने कारबाहीबारे न्याय प्रशासनसम्बन्धी ऐनमा उल्लेख गरिएको छ। उक्त ऐनको दफा १७ को उपदफा १ मा सर्वोच्च अदालतले आफ्नो र आफू मातहतका अदालतको न्याय सम्पादनका कार्यमा अवरोध गरेमा, फैसलाको अवज्ञा गरेमा अदालतको अवहेलनामा कारबाही चलाउन सक्ने उल्लेख छ। यदि केसीले अदालतको अवहेलना गरेको ठहरियो भने उनलाई कैद र जरिवाना दुबै हुन सक्छ। यस्तो व्यवस्था उक्त ऐनको उपदफा ४ मा गरिएको छ। ‘अदालतको अवहेलना गरेको ठहरेमा सम्बन्धित अदालतले कसूरदारलाई एक वर्षसम्म कैद वा दश हजार रुपैयाँसम्म जरिवाना वा दुबै सजाय वा अन्य उपयुक्त आदेश गर्न सक्नेछ,’ उपदफा ४ मा भनिएको छ। केसीले पक्राउपछि अदालतसँग क्षमा माग्न सक्ने छन्। उनले मागेको क्षमाप्रति अदालत सन्तुष्ट भए उनीविरुद्धको कारबाही तामेलीमा राख्न सक्ने छ।
