(updated) Serious ‘negligence’ in Nirmala probe: High-level panel A report of the high-level committee formed to look into the investigation of the rape and murder of Nirmala Panta has found serious “lapses” and “negligence” on part of the police in dealing with the case and booking the perpetrators on time. Nirmala Panta, 13, of Bhimdatta Municipality in Kanchanpur was found raped and murdered near her home on July 27, a day after she went missing. The report which was made public Sunday evening, 13 days after it was submitted to the Home Ministry, has accused the then chief of the District Police Office, Kanchanpur, SP Dilli Raj Bista of not protecting the evidences and initiating proper investigation right away. The report has recommended departmental actions against all the police personnel involved in the investigation of the case. Unsurprisingly, the report has not identified any suspects in the rape case. The 37-page report states the negligence on part of the police soon after Nirmala’s mother approached them asking for help in searching for her missing daughter. The report prepared by Joint-secretary Hari Prasad Mainali states that trained dogs were not used at the incident site to identify the culprits. The police also failed to seal and protect other evidences including Nirmala’s bicycle, notebook and guavas picked from the house of her friends—Babita and Roshani Bam. The report has expressed serious concerns over the police failure to arrest Anita Bam aka Babita and Anchal Bam aka Roshani immediately after the locals suspected their involvement in the murder. Nirmala had gone to their house at their request and disappeared from the same house, according to her family members. The probe report has termed the activities of the Bam sisters as suspicious. Police investigators, however, were reluctant for days to detain the Bam sisters. Instead of arresting the Bam sisters and initiating proper investigation to find possible suspects, the then police chief Bista had reportedly exerted pressure on the Nirmala’s family members to take away their daughter’s body. He had also forged the report of the field investigation, according to the probe committee. The family members of the victims were suspicious of the involvement of the Bam sisters in the case. A guava tree from which Nirmala had plucked some guavas was cut down soon after Nirmala’s death. “Public anger against police increased after the latter delayed in taking Babita and Roshani under custody and initiate investigation as demanded by the family members of the victims and the locals,” states the report, blaming the district police leadership for not initiating timely action to resolve the case. It has also blamed the local police officials of trying to frame a mentally-ill local, Dilip Singh Bista, without having proper evidence of his involvement in the case with the intent of diverting the attention of the rape case. The report states that police failed to protect evidences. Police, according to the report, had washed Nirmala’s clothes, her private parts and thighs to destroy semen. Due to lack of semen, police are now using vaginal swab to identity the culprits. Also, police led by SP Bista has been accused of using excessive forces when locals came to street demanding justice for Nirmala. A 17-year-old was killed and two others were injured in police firing. “When police opened fire, they breached the basic principle of using minimum force and there was no coordination among the security officials,” states the report. ............................................. The Ministry of Home Affairs (MoHA) has made the report public of Nirmal rape and murder.The MoHA has published the report through its official portal following the criticism from the civil society and human right activists. The report prepared by the high-level probe committee is of 37 pages. In its conclusion, the report mentions that Nepal Police remained indifferent though the police was informed the very day about the missing of Nirmala. Similarly, the report states that police personnel deployed in the evidence collection relating to the murder incident of Niramla also remained careless. Trained dogs were not used to identify the criminals while the sufficient number of security personnel were not deployed by the then police chief of the district in and around the sites where the dead body of Niramala was recovered, reads the report. Similarly, Anita Bam (Babita) and Aanchal Bam (Roshani) residing in the house from where Nirmala had gone missing were not taken into custody for investigations while Dilip Singh Bista was made public by extending his time for investigations without sufficient evidences, according to the report. The members of the victim family and general people expressed their doubt over the activities carried out by police due to behaviour and working style of the then Police Chief, Dilliraj Bista, police administration and some people exerted pressure to victim family to perform final rites of the deceased, reads the report. The report also suggested to carry out investigations against the police officials who were in probe committee as well as take action against them immediately. The panel suggested to take departmental action against some police personnel for their carelessness in the safety of the site, where the body of Nirmala was recovered. Similarly, the report also asked to take departmental action against the Superintendent of Police, Bista, as he was not found visiting the incident site even after getting information about such incident as well as he did not fulfill his responsibility in investigation of the case as per his position. The committee suggested to bring all suspected office-bearers in the incident as per the evidence, reality and circumstances of the incident under the ambit of the investigation and ensure social rehabilitation of the victims’ family members from the state side as the normal living of the victim family was affected. Through a minister-level decision, Minister for Home Ram Bahadur Thapa had formed a five-member panel on August 23. पठाएको नमुना ? निर्मला पन्तको बलात्कारपछि हत्याको अनुसन्धानका क्रममा प्रहरीले केन्द्रीय प्रहरी विधि विज्ञान प्रयोगशालामा पठाएको नमुना नै हेरफेर गरेको खुलासा भएको छ । घटनामा कञ्चनपुर प्रहरी प्रमुख समेत रहेका एसपी डिल्लराज विष्टसहितको टोलीले प्रमाण संरक्षण गर्नुका साटो नष्ट गरेको आरोप लागेको छ । सरकारी छानविन समितिले त्यसलाई सदर मात्र गरेको छैन्, प्रमाणका रुपमा प्रयोगशालामा पठाइएको नमुनामै हेरफेर गरेको खुलासा गरेको छ । प्रतिवेदनअनुसार जिप्रका कञ्चनपुरले भदौ ४ गते तयार पारेको बरामदी मुचुल्कामा उल्लेख भएको अमित गोल्ड लेखिएको निलो कट्टु, निलो रंगको भित्र शरीरमा लगाउने गन्जी र खैरो रंगको जिन्स सेन्डो गञ्जी हुन गएको र हाप पाइन्ट हुनुपर्नेमा नीलो रंगको हाफ पाइन्ट हुन गएकाले सच्चाइदिनुहुन अनुरोध गरेको देखिन्छ’, प्रतिवेदनमा भनिएको छ । यो पनि, निर्मलाको सामुहिक बलात्कार भएको ठहर, बविताको गतिविधि शंकास्पद मुचुल्कामा उल्लेख भएको निलो कट्टु, गञ्जजी र हाफ पाइन्ट दिलिपसिंह विष्टको घरबाट बरामद भएको थियो । प्रहरीले विष्टलाई मुख्य अभियुक्तका रुपमा सार्वजनिक गरेको थियो । तर, विष्टलाई दोषी प्रमाणित गर्न प्रहरीले नमुना परिर्वतन गराएको पाइएको छ । प्रहरी नायव निरीक्षक हरसिंह धामीका अनुसार विष्टले शौचालयमा हस्तमैथुन गरेको र हातमा विर्य लगाएर आएका थिए । त्यसपछि विष्टबाट बरामद भएको नयाँ नमुना प्रयोगशालामा पठाएको छानविन समितिको ठहर छ । ‘प्रयोगशालामा पठाइसकेको नमुना किन परिर्वतन गर्नु पर्‍यो ?’, छानबिन समितिका एक सदस्यले भन्छन्, ‘मुचुल्कामा उल्लेख भएको नमुना हेरफेर गरेर अपराधी लुकाउन खोजिएको छ ।’ ................................................ निर्मलाको सामूहिक बलात्कार भएको ठहर, वविताको गतिविधि शंकास्पद कञ्चनपुरकी १३ वर्षीया बालिका निर्मला पन्तको बलात्कार र हत्याबारे छानविन गर्न गठित उच्चस्तरीय समितिले शंकाको सुई वविता भनिने अनिता बमतर्फ सोझ्याएको छ । गृहमन्त्रालयले आइतबार सार्वजनिक गरेको प्रतिवेदनको ३४ औं पृष्ठमा भनिएको छ- ‘अनिता बमको गतिविधि शंकास्पद देखिन्छ ।’ समितिको प्रतिवेदनले निर्मलाको हत्या एकजनाले गर्न सम्भव नभएको भन्दै सामुहिक बलात्कार भएको विश्लेषण गरेको छ । एकजनाबाट बलात्कार सम्भव नभएको तर्क गर्दै समितिको प्रतिवेदनमा यसो भनिएको छ– ‘दिउँसोको समय र मान्छेहरुको आवत–जावत भइरहने सडक नजिकै एउटा व्यक्तिबाट आकस्मिकरुपमा बाटोमै समाती जबरजस्ती करणी गर्न असम्भव देखिने । किनकी, दुई हातले समातेर लिँदा पनि बालिका चिच्याउनुपर्ने, लास फेला परेको उखुबारी नजिकै घरमा दुईवटा कुकुर रहेको र चक्रदेव बडू तथा निजका बाबुसमेत उक्त दिन घरमै भएको भन्ने भनाइ र पोष्ट मार्टम रिपोर्टमा बालिकाको तौल ४०/४५ केजी उल्लेख गरिएको, एकजनाले आकस्मिकरुपमा बलात्कार गर्न एकहातले बालिकालाई समाते पनि अर्को हातले मुख थुनेको भए बालिकाको सुरुवाल, पेन्टी र आफ्नो पाइन्ट, हाफ पाइन्ट पनि खोल्न गाह्रो हुनसक्ने भएकाले एकजनाले मात्र आकस्मिक बलात्कार गर्न सम्भावना कम देखिएको ।’ उखुबारीमा निर्मलाको बलात्कार र हत्या नभई बाहिरबाट हत्या गरेर त्यहाँ शव फालेको ठहरमा समिति पुगेको छ । निर्मलाका कितावहरु पानीमा नभिजेको ओभाना देखिएको हुनाले उनलाई अन्यत्रै हत्या गरेर ती कितावहरु घटनास्थानमा पछि राखिएको समितिको निश्कर्ष छ । निर्मला पन्त हराएको दिन बम दिदीबहिनीहरु ट्युसन सेन्टरमा अनुपस्थित भएको समितिको प्रतिवेदनमा उल्लेख छ । तर, बबिता (अनिता) बम र उनका बुबाले ट्युसन सेन्टरमा गएर आफूहरु उक्त दिन ट्युसन पढ्न आएका थिए भनिदिनोस् भनेर आग्रह गरेका कारण उनीहरुको गतिविधि शंकास्पद रहेको समितिले निश्कर्ष निकालेको छ । यो पनि, निर्मला हत्याकाण्डको प्रतिवेदन सार्वजनिक (पूर्णपाठसहित) समितिले आफ्नो सुझावमा यो घटनाबारे विशेष अनुसन्धान टोली बनाई अनुसन्धानको दायरा फराकिलो बनाउँदै लैजानुपर्ने सुझाव दिएको छ । साथै, प्रहरीहरुलाई समेत छानविनको दायरामा ल्याउन सुझाव दिइएको छ । कट्टु, पेन्टी, सुरुवाल सबै गरिएका उल्लेखित वस्तुहरु हाल नभेटिएको समितिको प्रतिवेदनमा उल्लेख गरिएको छ । त्यसैगरी घटनास्थलबाट नीलो रंगको सेन्डो गञ्जी र खैरो रंगको जिन्स हाफपाइन्ट बरामद गरिएको कागजमा उल्लेख भएकोमा नमूना परीक्षणको पत्रलाई सच्याउन जिप्रकाले अर्को पत्र पठाएको समितिले प्रतिवेदनमा उल्लेख गरेको छ । ‘सेतो गञ्जी हुनुपर्नेमा नीलो रंगको सेन्डो गञ्जी हुन गएको र हाप पाइन्ट हुनुपर्नेमा नीलो रंगको हाफ पाइन्ट हुन गएकाले परीक्षणलाई समितिले ‘चलाखीपूर्ण’ भनेको छ । प्रतिवेदनको २४/२५ पृष्ठमा लेखिएको छ, ‘महाकाली अञ्चल अस्पतालमा २३ साउनको शव परीक्षणको रिपोर्टमा मृतकको भेजिनामा वीर्यको जीवाणु नदेखिएको र कन्र्फम गर्न भजाइनल स्वाब नेशनल फरेन्सिकमा पठाउने भनिएको पत्रको व्यहोरा र मृतकलाई पानीमा घोप्टो पारेर प्रमाण लोप हुने गरी राखिएको अवस्थाले पनि उक्त कार्य चलाखीपूर्णरुपमा गरेको जस्तो देखिन्छ ।’ समितिले गरेका सिफारिसहरु उच्च् स्तरीय समितिले आरोपी दिलिपसिंह विष्टलाई केरकार गर्ने क्रममा यातना दिने प्रहरीका साथै तत्कालीन एसपी डिल्लीराज विष्टसमेतलाई विभागीय कारवाहीको सिफारिस गरिएको छ । घटनाको अनुसन्धानमा संलग्न प्रहरीले हेलचेक्राइँ र लापरवाही गरेको प्रतिवेदनमा ठहर गरिएको छ र त्यसमा सहभागी सबै प्रहरीलाई विभागीय कारवाही गर्न सिफारिस गरिएको छ । त्यसैगरी प्रहरीको गोलीबाट घाइते भएकाहरुलाई निर्वाह भत्ता उपलब्ध गराउन भनिएको छ । पीडितलाई सामाजिकरुपमा पुनस्र्थापना गराउन सिफारिस गरिएको छ । त्यसैगरी घटनाको अनुसन्धानमा खटिने प्रहरीलाई प्रदर्शन नियन्त्रणमा नखटाउन भनिएको छ । अबदेखि जिल्लामा प्रहरीहरु खटाउँदा स्थानीयबासीलाई नखटाउन भनिएको छ । अनुसन्धानमा खटिएका प्रहरीले पीडितलाई पनि साथमा लिन भनिएको छ । त्यसैगरी सम्भावित परिस्थितिबारे आँकलन गर्दै राष्ट्रिय अनुसन्धान विभागलाई सक्रिय बनाउन सुझाव दिइएको छ । घटनामा पूर्व अनुसन्धानमा खटिएको तत्कालीन जिल्ला प्रहरी कार्यालय कञ्चनपुरको प्रहरी अधिकृत र कर्मचारीमाथि छानबिन समितिले सुक्ष्म अध्ययन गरिरहेको छ। गत भदौ ३१ गते सरकारले प्रहरी अतिरित्त महानिरीक्षक धिरु बस्न्यातको संयोजकत्वमा गठन गरेको छानबिन समितिले निर्मला प्रकरणमा अनुसन्धानमा प्रहरी कर्मचारीको भूमिका र सम्पादन भएका कार्यको सुक्ष्म अध्ययन गर्दै टोली शुक्रबार भीमदत्तनगर आइपुगेको छ। गठन भएकै समयदेखि तोकिएको जिम्मेवारी अनुसार अनुसन्धानमा खटिएको प्रहरी अतिरित्त महानिरीक्षक बस्न्यातको टोलीले अनुसन्धानमा खटिएका यहाँका २६ जना प्रहरीमाथि छानबिन भइरहेको जनाएको छ। “अनुसन्धानका क्रममा प्रहरीबाट भएको कमजोरी र भूमिका शङ्कास्पद देखिए हामी कडाभन्दा कडा कारवाही गछौं।” आज बिहान कञ्चनपुरका सञ्चारकर्मीसँग घटनाबारे छलफल गर्दै छानबिन समितिका संयोजक प्रहरी अतिरित्त महानिरीक्षक धिरु बस्न्यातले भने,“छानबिन टोली दिनरात नभनेर अनुसन्धानमा खटिएको छ।” संयोजक बस्न्यातले घटनासँग सम्बन्धित सूचना दिन सबैपक्षसँग आग्रहसमेत गरे। शुक्रबार यहाँ पुगेलगत्तै निर्मला पन्तका पीडित परिवार, घटनास्थल, यसअघि घटनाका अभियुक्त बनाइएका दिलीपसिंह विष्टका परिवारसँग समेत छानबिन समितिले भेट गरेको छ। त्यसैगरी आज बिहान टोलीले घटनाकै विषयमा महिला तथा मानव अधिकारकर्मीसँग छलफल गरेको छ। छानबिन समितिसँगको छलफलमा तत्कालीन अवस्थामा अनुसन्धानमा
