Woman Claims Police Reluctance to Register Case despite Mandamus

Saptari/September 10 Matya Kumari Rai alias Maya Devi, 33, of Tarahi VDC-3 has complained that despite the mandamus issued by the Appellate Court, the police were reluctant to register a case against three for assaulting her on charge of being a witch. According to her, division bench Om Prakash Mishra and Tej Raj Nepal has issued the order of action to Nepal District Police and District Administration Office as per her FIR agaisnt Rajeshwar Prasad Ray, Gina Devi Ray and Mina Devi Rai of the same place. The mandamus was issued on July 14, 2013. The mandamus had recognized that the allegation of being witch had violated the people’s civil rights and was also illegal, the defending offices should follow the law if the FIR is filed against the accused. Matya Kumari says she was beaten up on the public road in Tarahi VDC-3 on February 11, 2013 on charge of being witch. She filed a complaint at District Police Office on February 18 but police took no action forcing her to move Appellate Court on April 12. Her lawyer Nabin Singh said that by showing the reluctance, the police had committed contempt of court and revictimized the victim. M
