काठमाडौं मनपा-१६ स्वयम्भू घरभएकी समलिङ्गी रजनी शाहीलाई माइती नेपालले बन्दी बनाएको भनि परेको रिटमा सर्वोच्च अदालतले माइती नेपाल र राष्ट्रिय महिला आयोगलाई तीन दिनभित्र बन्दी सहित अदालतमा उपस्थित हुन आदेश दिएको छ । न्यायाधिश गिरिशचन्द्र लालको ०६९ कार्तिक १५ गते एकल इजलासले बन्दीसहित ०६९ कार्तिक १९ गते उपस्थित हुन सो आदेश दिएको हो ।

 

काभ्रे जिल्ला ढुङर्खर्क गाविस-९ घर भएकी प्रेमकुमारी नेपालीले ०६९ कार्तिक १४ गते आफ्नो साथी रजनीलाई माइती नेपालले बन्दी बनाएको भन्दै सर्वोच्च अदालतम रिट दर्ता गरेकी हुन् ।

 

रजनीको यौनिक भावना कुण्ठित भएको र माइती नेपालले बन्दी बनाई कसैसँग भेट्न नदिएको रिटमा उल्लेख गरिएको सर्वोच्च अदालतका रजिस्ट्रार श्रीकान्त पौडेलले जानकारी गराए । दायर रिटमा पीडित रजनीको पति, राष्ट्रिय महिला आयोग र माइती नेपाललाई विपक्षी बनाइएको छ । 

 

सर्वोच्च अदालतका रजिष्ट्रार पौडेलले भने-"रजनी शाही समलिङ्गी भएकोले यौनिक भावनाको लागि उनको साथी प्रेमकुमारी नेपालीसँग बस्दै आएको कारण पतिले विभिन्न मानसिक यातना दिएको र ०६९ भदौ २२ गते पीडित मानवअधिकार आयोगका प्रतिनिधि, जिल्ला प्रहरी कार्यलय र महिला आयोगको संयुक्त बैठकले काभ्रेको सुरक्षावासमा राख्ने निर्णय गरेको थियो । निर्णयको केहि दिनमै पीडितलाई महिला आयोगको सिफारिशमा करिब २ महिनादेखि माइति नेपालले राखी रहेको छ ।"

The Supreme Court has asked National Women Council and Maiti Nepal to appear at the Court with Rajani Shahi of Swayambhu in Kathmandu Metropolis-16 within three days.

 

Single bench of Girish Chandra Lal issued the direction on October 31.

 

Prem Kumari Nepali of Dhungkharka9 in Kavre district had filed a habeas corpus writ petition on October 30 claiming that Maiti Nepal had held Shahi hostage.

 

According to the SC registrar Srikant Paudel, the writ petition claimed that Maiti Nepal had barred anyone from meeting her and impaired her homosexual feelings. The petition had made Rajani's husband, NWC and Maiti Nepal as the defenders.

 

Paudel said that, a joint meeting of the representatives of NHRC, District Police Office and NWC on September 5, had decided to place Shahi in the shelter in Kavre as her husband was tormenting her physically and mentally for choosing Nepali over him. After a few days, Shahi is being kept at Maiti Nepal after recommended by NWC.
