The Supreme Court has issued a show cause notice regarding the petition filed against the strike called by the resident doctors association at National Academy of Medical Science (NAMS) in Bir Hospital.
A single bench of Justice Baidhyanath Upadhyaya issued the notice on August 3 asking the defendants to provide reasons in written within 15 days, said the writ petitioner Sunil Niranjan Singh.
The agitating doctors had resumed services at the hospital following agreement with the hospital administration on August 3. Singh said that the court, while taking this in consideration, only issued the show cause notice.
Singh had filed a petition at the apex court on July 31 demanding the strike to be immediately stopped or made to be stopped. He stated that the strike had violated the people's fundamental right as a sensitive and essential service like health was interrupted.
Office of the Prime Minister and Council of Ministers, Ministry of Health, Ministry of Home Affairs, RDA of NAMS were made defendants in the petition.

चिकित्सा विज्ञान राष्ट्रिय प्रतिष्ठान न्याम्समा आबद्ध आवासीय चिकित्सक सङ्घले स्वास्थ्य सेवा बन्द गरी वीर अस्पतालमा शुरू गरेको हड्ताल रोक्न माग गर्दै सर्वोच्च अदालतमा दायर भएको रिट उपर कारण देखाउ आदेश जारी गरिएको छ ।
सर्वोच्चका न्यायाधीश वैधनाथ उपाध्यायको साउन १८ गतेको एक इजलासले विपक्षीका नाममा १५ दिनभित्र लिखित रूपमा जवाफ पेश गर्न कारण देखाउ आदेश जारी भएको रिट निवेदक अधिवक्ता सुनिलरञ्जन सिंहले बताए ।
विपक्षीहरूले वीर अस्पताल प्रशासनसँग साउन १७ गते सहमति गरी अस्पतालका सेवाहरू सुचारू गरेका थिए । सोही कुरालाई अदालतले मनन गर्दै विपक्षीको नाममा कारण देखाउ आदेश मात्र जारी गरिएको निवेदक सिंहले जानकारी दिए ।
स्वास्थ्य जस्तो अति संवेदनशील र अत्यावश्यक सेवा ठप्प पारी सर्वसाधारणको मौलिक हक हनन् गरिएको भन्दै हड्ताल तत्काल रोक्न वा रोक्न लगाउनका लागि उत्प्रेशणयुक्त परमादेशको माग राखि निवेदक सिंहले साउन १५ गते सर्वोच्चमा रिट दायर गरेका थिए ।
दायर रिटमा नेपाल सरकार प्रधानमन्त्री तथा मन्त्रिपरिषद्को कार्यालय, स्वास्थ्य मन्त्रालय, गृह मन्त्रालय, र चिकित्सा विज्ञान राष्ट्रिय प्रतिष्ठान वीर अस्पतालका आवसीय चिकित्सक सङ्घलाई विपक्षी बनाइएको थियो ।
