Police yet to decide charges against child abuser for filing a case

Police have not yet decided as to what case Durga Shrestha, arrested for beating and injuring a 9-year-old boy, be charged with. A permanent resident of Hatiya in Hetauda Municipality-22 and staying in her husband's house in Pulbazaar of Ugratara Janagal VDC-1, Durga, 24, was arrested for inflicting injuries to the boy. According to neighbors, Durga had been beating the boy for the last three months. Durga was married to Riddhi Lal Shrestha as his third wife seven months ago while the boy is kept as their godchild. Durga has a 3-month-old daughter with Ridhhi Lal. The boy, a second-grader, has suffered injuries in his cheek, arms, and body. According to the victim, Durga inserts a sharp rod on him, puts him into a safety tank, scratches him, and does not allow him to put on clothes. The accused has admitted her deed in custody and asked to offer her apology for one time. It has been learned that Durga started inflicting injuries to the boy daily after Ridhhi Lal transferred his house jointly in the name of him and his godson. Locals staged a sit-in the whole day demanding action against the accused at the DPO. Riddhi Lal, a driver by profession, was not in the home when the incident took place. Clause 7 of the Children Act states that minor beating and scolding of children by parents, members of a family, guardian, and teacher for their welfare does not constitute a violation of the act. Clause 53 (3) of the Act has the provision of a penalty of Rs 5000 or one-year jail term or both for violation of Clause 7. However, the police refused to file the complaint of the boy's maternal uncle stating that the case did not fall under Annex 1. The victim's relatives are also confused about whether to file the case under public offense, domestic violence, murder attempt, or other charges. Police is preparing to send the case to the Child bench under the District Court after conducting an injury check-up of the victim.
