Demonstration against arrest of Dev Narayan Yadav by Indian Security Force

[Updated] The human rights activists and members and representative of civil society have staged a demonstration in Maitighar Mandala on October 3 with the objective of exerting pressure on government to initiate early release of Dev Narayan Yadav of Saptari without any condition who was arrested by the Indian security force. During the demonstration program, INSEC chairperson Subodh Raj Pyakurel accused that Yadav was arrested by the Indian security force just because he showed his patriotism and said that this is the example of atrocity by the Indian security force. Senior advocate Shambhu Thapa expressed his view saying that it is necessary that government must protect the family of Dev Narayan while going through a legal process. Foreign affair expert Hiranya Lal Shrestha urged government not to be silent on this serious issue and solve this through diplomatic mission and dialogue. He added that India has made illegal barrage in Nepali border and all intellectuals must condemn this deed. Senior advocate and former chairperson of Bar association Nepal ,Tika Ram Bhattarai urged government to initiate the release of Dev Narayan Yadav. Dev Narayan Yadav of Saptari, Tilatha Rural Municipality-4 was arrested by the Indian security force from the border of Indian Bazar of Kunauli on October 1 while he was on the way to gather information about the arrest of his son Ajaya Kumar by Indian Security Force on same day. भारतीय सुरक्षाकर्मीद्वारा गिरफ्तार गरिएका सप्तरीका देवनारायण यादवको बिना शर्त रिहाइका लागि पहल गर्न सरकारलाई दबाव दिने उद्धेश्यले मानव अधिकारकर्मी तथा नागरिक समाजका प्रतिनिधिहरूले असोज १७ गते काठमाडौँको माइतीघर मण्डलामा प्रदर्शन गरेका छन् । प्रदर्शन कार्यक्रममा अनौपचारिक क्षेत्र सेवा केन्द्र (इन्सेक) का अध्यक्ष सुबोधराज प्याकुरेलले देशभक्तिपूर्ण व्यवहार गरेकै कारण रिसिइवी साँधेर देवनारायणलाई बिना कारण गिरफ्तार गरी दुःख दिएको आरोप लगाए । उनले भने-‘सवालिकहरूले आपसी रजाबन्दीमा विवाह गर्न पाउने भारतीय कानुनकै बर्खिलाप गरिएको भारतीय प्रहरीको ज्यादतीको नमूना हो यो ।’ नेपाल बार एशोसिएशनका पूर्व अध्यक्ष एवम् वरिष्ठ अधिवक्ता शम्भू थापाले कानुनी प्रक्रियामा जाँदा प्रमाणको रूपमा रहेको देवनारायणकी बुहारी तथा उनका परिवारको संरक्षण सरकारले गर्नु पर्ने विचार राखे । परराष्ट्रविद हिरण्यलाल श्रेष्ठले यस घटनामा सरकार चुप लागेर बस्नै नहुने उल्लेख गर्दै कुटनीतिक पहलमार्फत यादवलाई छुटाउन सरकारलाई आग्रह गरे । भारतले नेपालको सीमा क्षेत्रमा अनुचित रूपमा बाँधहरू बनाएको भन्दै उनले बौद्धिक जगत, सीमाविद र नागरिक समाजका प्रतिनिधिहरूले भारतको ज्यादतीको घोर भत्सर्ना गर्नु पर्ने बताए । नेपाल बार एशोसिएशनका पुर्व उपाध्यक्ष तथा वरिष्ठ अधिवक्ता टिकाराम भट्टराईले भारतीय सुरक्षाकर्मीले गिरफ्तार गरेका देशभक्त देवनारायणको बारेमा सरकारले केही सार्वजनिक नगरेकोले तत्काल उनको रिहाइको लागि पहल गर्नु पर्ने बताए । विश्लेषक डा.सुरेन्द्र केसीले घटनाको चुरो पत्ता लगाउनु पर्ने उल्लेख गर्दै परनिर्भर सरकार र राजनीतिक दलहरूले देशभक्त नागरिकको हक अधिकारको रक्षा गर्न नसक्ने ठोकुवा गरे । नेपाल सरकारका पूर्वसचिव द्वारिका ढुङ्गेलले राष्ट्रले सम्मान गरेको व्यक्तिलाई भारतीय सुरक्षाकर्मीले गिरफ्तार गरेको उल्लेख गर्दै उनको रिहाइका लागि लाग्नु पर्नेमा सरकार कानमा तेल हालेर बसेको आरोप लगाए । उनले भने-“छिमेकी चाहिन्छ । तर, छिमेकीले कस्तो व्यवहार गर्छ ? त्यसप्रति सचेत रहनु पर्छ ।” सप्तरी जिल्ला तिलाठी गाउँपालिका-४ का देवनारयाण यादवका छोरा अजयकुमारलाई भारतीय सुरक्षाकर्मीले सप्तरीको तिलाठीको सीमावर्ती भारतीय बजार कुनौलीबाट असोज १४ गते गिरफ्तार गरेको थियो । गिरफ्तार छोराको बारेमा बुझ्न गएका देवनारायणलाई असोज १४ गते नै भारतीय प्रहरीले गिरफ्तार गरेको थियो । देवनारायण र उनका छोरा अजयविरुद्ध गत जेठ २० गते भातरको कुनौली ग्राम-१ बस्ने ज्योतीकुमारी साहलाई अपहरण गरेको उजुरी दर्ता भएकोले गिरफ्तार गरिएको भारतीय सुरक्षकर्मीले जनाएको बताइएको छ । तर, अपहरणमा परेको भनिएकी ज्यातीकुमारीले आफू अपहरणमा नपरेको र अजयकुमारसँग विवाह गरेर आएको अभिव्यक्ति सार्वजनिक गरेकी छन् । गत वर्ष नेपाल र भारतीय सीमा क्षेत्रमा रहेको खाडो नदीमा भारतीयहरूले बाँध बाधेपछि सो क्षेत्र डुबानमा परेको बेला देवनारायणको अगुवाईमा सो बाँध भत्काउँदा झडप भएपछि उनी घाइते भएका थिए । Update.... After eight days in Indian prison, Dev Narayan Yadav and his son Ajaya of Saptari’s Koiladi Tilathi Rural Municipality-1 have been freed today. They were kept in Birpur prison over a human trafficking and hostage-taking case pressed against them. The duo was released after the single bench of judge Lal Bahadur Prasad of Birpur court’s order that invalidated the abduction case upon hearing the statement of the supposedly-abducted Indian girl and Ajaya’s wife, who clarified that she had married Ajaya on her own accord, not kidnapped. Following the arrest of their kin, Dev Narayan’s family had reached Birpur taking Ajaya’s wife Jyoti along four days ago. “Though late, the verdict has served us justice,” Ajaya’s kin said. In her statement, Jyoti had stated that the abduction case filed by her brother Sanjiv against her husband and father-in-law was fake. Earlier, police had arrested and filed a case against Dev Narayan and his son acting on a complaint filed by Sanjiv at the Kunauli police post. Commenting over the arrest, the Yadav family has described the incident as a set up to settle an old score. According to them, the case was purely fabricated by the Indian side to avenge the retaliation of the locals of Tilathi of Nepal led by Dev Narayan against the construction of a dam in the Das Gaza area last year. Earlier, Home Minister Janardan Sharma had instructed the chief district officer of Saptari to take immediate initiatives to free the duo.
