Saptari/ July 15 The Appellate Court (AC) in Rajbiraj has issued a mandamus in the name of District Administration Office and Area Police office, Kanchanpur on July 15 to register the rape case. A joint bench of Chief Judge of AC Om Prakash Mishra and Tek Raj Nepal issued order to take the legal proceedings forward by registering the case of attempted rape, according to the section officer at AC Rit Bahadur Pulami. The victim’s father had lodged a petition demanding Mandamus against police and administration accusing them of protecting the perpetrator on February 26, 2013. The victim’s father has been accusing Roshan Kumar Mandal, 22, of Praswani VDC-9 of attempting to rape his 14-year-old daughter on the night of January 24. The victim’s father had lodged the writ according to the Civil Rights act 2012 after the local police office, Kanchanpur and Mahuli Police post refused to register the rape case. Former SP Sanjaya Singh Basnet of District Police office said that the incident was a beating instead of rape and the case has been settled. Manohar Kumar Pokharel सप्तरी । ०७० असार ३१ गते पुनरावेदन अदालत राजविराजले बलात्कार प्रयासको मुद्दा दर्ता गरी कानुनी प्रकृया अगाडि बढाउन जिल्ला प्रशासन कार्यालय र इलाका प्रहरी कार्यालय कञ्चनपुरका नाममा असार ३० गते परमादेशको आदेश जारी गरेको छ । पुनरावेदन अदालतका मुख्य न्यायाधीश ओमप्रकाश मिश्र र न्यायाधीश टेकराज नेपालको संयुक्त इजलाशले जबरजस्ती करणी उद्योगको मुद्दा दर्ता गरी कानुनी प्रकृया अगाडि बढाउन आदेश जारी गरेको अदालतका शाखा अधिकृत रितबहादुर पुलामीले जानकारी दिए । बलात्कार प्रयासको घटनामा प्रहरीले मुद्दा दर्ता नगरी पीडकको संरक्षण गरिरहेको आरोप लगाउँदै पीडित बालिकाका पिताले ०६९ फागुन १५ गते अदालतमा प्रहरी र प्रशासनविरुद्ध निषेधाज्ञा मिश्रित परमादेशको रिट दायर गरेका थिए । प्रसवनी गाविस-९ का २२ वर्षीय रोशनकुमार मण्डलले ०६९ माघ ११ गते राती ८ बजे आफ्नी १४ वर्षीया छोरीलाई बलात्कारको प्रयास गरेको आरोप पीडितका पिताले लगाउँदै आएका छन् । घरमा बसेर पढिरहेकी छोरीमाथि बलात्कारको प्रयास गर्ने आरोपी विरुद्ध दिएको उजुरी इलाका प्रहरी कार्यालय कञ्चनपुर र महुली प्रहरी चौकीले दर्ता नगरेपछि पीडितका पिताले नागरिक अधिकार ऐन २०१२ बमोजिम अदालतमा परमादेशको रिट दायर गरेका थिए । जिल्ला प्रहरी कार्यालयका तत्कालिन एसपी संजयसिंह बस्नेतले बलात्कार प्रयास नभई कुटपिटको उक्त घटना प्रहरी चौकी महुलीमा मिलापत्र भइसकेको बताएका थिए । मनोहरकुमार पोखरेल
