Constitution Must on Stipulated Time to End Impunity

Constituent Assembly members have expressed concerned over the increasing impunity in the country and have also stressed that timely promulgation of the constitution on January 22, 2015 is necessary for its end. Speaking at a program, “Issue of Impunity in New Constitution” organized by INSEC on December 26, the CA members said that the delay in the constitution will add up the impunity in the country. CA member Gyanu Gaire of UML said that it was tragic that Nanda Prasad Adhikari died while asking for justice and added that by ensuring proper reward and punishment for deserving acts would help to end impunity. She also demanded for 50 per cent women participation and 20 per cent dalit participation with compensation to the dalits in the new constitution. NC’s Sarbatara Khanam said that amnesty to the perpetrators of human rights in any pretext will increase impunity in the future. CA member Shakuntala Rajbhandari opined that decreasing humanitarian sensitivity had increased impunity and stressed on people’s easy access to justice. Another CA member Jeevan Shrestha said that the members should rise above the party interest to achieve time constitution and added that the new constitution should adopt zero impunity policy. Speaking the program, INSEC chairperson Subodh Raj Pyakurel said, “If there is no punishment, then there is no crime. Reconciliation does not mean exemption of punishment. Rather a law regarding exemption can be formulated and the verdicts made on its basis”. There is impunity- social impunity and also impunity in domestic violence, Pyakurel said adding individual accountability, social accountability and professional accountability can address the issue of impunity. Presenting his paper on, ‘Strengthening Rule of Law in New Constitution and Issue of End of Impunity for Lasting Democratic Rule’, Advocate Govinda Bandi said that though the political parties were linked to different issues and changes since 1951 but the same issues were yet to be addressed.
