Ex-lawmaker Sah to remain in judicial custody

The Supreme Court has upheld the decision of Janakpur Appellate Court and Dhanusha District Court to send suspended lawmaker Sanjay Kumar Sah, the prime accused in the Janakpur bomb blast case, to judicial custody. A division bench of Chief Justice Kalyan Shrestha and Justice Om Prakash Mishra on Wednesday stated that no legal or procedural errors were seen on the decision of Janakpur Appellate Court that upheld the order of Dhanusha District Court to send Sah into judicial custody. The appellate court had upheld the order of the district court stating that the decision to send Sah to judicial custody was valid in line with the provisions of the Civil Code given the strong evidence like call details and statements from Sah's accomplice Mukesh Kumar Chaudhary established his involvement in the crime. Sah had moved the Supreme Court on January 18, 2015, challenging the decision of the appellate court that upheld the order of the district court. After police charge-sheeted Sah as the prime accused in the bomb blast, the district court on May 8, 2014, had sent Sah to judicial custody. The appellate court had upheld the district court order on December 4, 2014. Five people were killed when a bomb went off in Janakpur on May 1, 2011, near a group of protesters who were demanding Mithila province in the new constitution.
