SC throws out petition against army mobilization

2015-08-28

Bagmati, Kathmandu, Kathmandu

The Supreme Court on Friday struck down the petition that sought an order against army mobilization in riot-hit areas. A single bench of Chief Justice Kalyan Shrestha on Friday quashed the petition on the very first hearing stating that the petition was premature. Advocates Roshan Kumar Jha and Yam Kumar Yonjan on Thursday had filed the petition claiming that the mobilization of Nepal Army personnel is against the constitution. They had argued that the army can be mobilized only through the decision of the National Security Council. The advocates had stated in their petition that the government was mobilizing the Nepal Army in the Madhes region to suppress the protests of Madhesi people, an argument the bench termed premature since the government has not yet mobilized Nepal Army in Madhes. The Nepal Army has started patrolling streets in Tikapur of Kailali for security after a mob killed seven security personnel and a child in the district on Monday.
