AF Appeal: Illegal detention of family members of an accused for last 40 days, immediate intervention needed

Advovacy Forum Report Background of the incident: Ajeev Budha Magar, 21, a resident of Thakur Dwara VDC-04, Bardiya district was arrested by police on 18 February 2016 [2072/11/06] after a villager named Jora Singh Thapa aka Jore Thapa was found dead on 17 February 2016 [2072/11/05] in his village. After arrest he was detained at District Police Office, Bardiya however on 13 March 2016 [2072/11/30] he ran away from police custody from the premise of Bardiya District Court while he was taken there for his remand. The following day police arrested his mother Tulasa Budha, 51, elder sister Manju Thapa and her 1½-year-old son Prashant Thapa (who had visited her maternal house a few days ago), his wife Namrata Thapa, 18, and his son Sishir Budha, 3, were illegally detained one night at Thakurdwara Police Office and the following day they were transferred to Bhurigaun Police Office where they were detained from 12 to 20 March 2016. On 20 March 2016 [2072/12/07] they were transferred to a Women Rehabilitation Home run by a Cooperative in support of the District Women Development Office, Bardiya. Laxmi Budbari, In Charge of Women Rehabilitation Home, said, "Though we provide rehabilitation support to the women suffered from domestic violence but due to pressure from police administration we have kept them here despite our guidelines and work criteria do not allow us for it." The victims who are illegally detained in the Rehab home for more than 40 days complained of keeping them without any cause or crime they committed. They complained that their children's study is discontinued and their home, domestic animals, and cultivations are ruined. They have written a letter in the name of District Bar and Advocacy Forum that writes, "We were illegally detained one night at Thakudwara Police Station, 7 days in Bhurigaun Police Station and 1 month in Guleriya Service Center (referring Women Rehab Center) without our consent. So, please provide us the necessary help to get out of here." With the visiting team, they complained, "We have been kept in police surveillance for the last 40 days without allowing us to contact to the outside world. We are not allowed to go outside from this home like we are under house arrest. We can talk only in the presence of a police officer. So, please, help us to get out of this house and return to our homes." They are under 24-hour police surveillance where two policewomen: Head Constable Aiti Khatri and Constable Saraswoti Barma from District Police Office, Bardiya are on duty. AF and Bar's Support: On 19 April 2016 [2073/01/07] AF lawyer and representatives of District Bar visited District Police Office, Bardiya, and tried to meet the In Charge there however both the Superintendent of Police (SP) and Deputy Superintendent of Police (DSP) was out of the office. So, the team met Police Inspector Suresh Malla from the Litigation Section. After talking to him about the illegal custody of 5 persons including juveniles, he said that they were kept there for their security from the family and relatives of the person who was found dead. He further said that they were kept there that it would easy to arrest Ajeev Budha Magar if he comes in contact with his family members. He said that he would talk to his seniors about it.
