Dad of disappeared seeks action against Bhairavnath

A complaint was filed at the Commission for Investigation of Enforced Disappeared Persons (CIEDP) on Monday demanding legal action against Nepal Army personnel who were with the Bhairavnath Battalion during the state of emergency at the time of the Maoist armed insurgency. Bhim Bahadur Basnet filed a complaint at CIEDP claiming his two sons were arrested and disappeared by the security forces, including the Nepal Army. Basnet has claimed that his sons were detained and tortured at the Bhairabnath Battalion at Maharajgunj and they were later disappeared by the army. Basnet has named ex-king Gyanendra, then prime minister Surya Bahadur Thapa, then home minister Kamal Thapa, then army chief Pyar Jung Thapa, then IGP of Nepal Police Shyam Bhakta Thapa, then chief of Bhairavnath Battalion Raju Basnet, Major Bibek Bista, Captain Indibar Rana and then chief of Nepal Army's intelligence division Dilip Rayamajhi as perpetrators. Likewise, Basnet has fingered former prime minister Sher Bahadur Deuba, CPN-UML leader Madhav Kumar Nepal, Nepali Congress leader Ram Chandra Paudel and Prime Minister KP Sharma Oli for endorsing the state of emergency and promoting the enforced disappearance and extra-judicial killings of individuals. Basnet has claimed that his son Pushpa Raj was arrested by Nepal Army personnel on December 5, 2003 from Kalimati, Kathmandu while another son, Dhirendra, was arrested from Kalanki on December 15, 2003. A report published by the Office of the High Commissioner for Human Rights (OHCHR) in 2006 states that Dhirendra and Pushpa Raj had both been seen at Bhairabnath Battalion. The report says Pushpa Raj was at Bhairabnath, on the basis of the recorded statements of 15 other detainees at the same battalion. They had told a human rights team that Pushpa Raj was with them during their period of detention. Birendra Basnet, the elder brother of Dhirendra and Pushpa Raj, was also kept at Bhairabanath Battalion. According to him, his two younger brothers were both at the battalion during that period. Similarly, Krishna KC, Bina Magar and Ramesh Guragain also reported to have seen Pushpa Raj at the battalion while they themselves were also captives there. सत्य निरुपण तथा मेलमिलाप आयोगमा तत्कालीन राजा ज्ञानेन्द्र, प्रधानमन्त्री केपी शर्मा ओली तथा प्रमुख विपक्षी दलका नेता शेरबहादुर देउवा लगायतलाई कारवाही माग गर्दै उजुरी परेको छ। सेनाको भैरवनाथ गणबाट बेपत्ता पारिएका दमक–१ का पुष्पराज तथा धिरेन्द्र बस्नेतका परिवारले सोमबार दर्ता गराएको उजुरीमा तत्कालीन प्रधानमन्त्री सूर्यबहादुर थापा, गृहमन्त्री कमल थापा, तत्कालीन एमाले महासचिव माधवकुमार नेपाल, कांग्रेस नेता रामचन्द्र पौडेललाई पनि विपक्षी बनाइएको छ। २०६० मंसिरमा सादा पोशाक सुरक्षाकर्मीले कालिमाटी र कलंकीबाट पक्राउ गरी उनीहरुलाई महाराजगञ्जस्थित तत्कालीन शाही नेपाली सेनाको भैरवनाथ गणमा लगेर यातना दिएको र त्यहीँबाट बेपत्ता पारेको उजुरीमा उल्लेख छ। सत्य निरुपणमा दर्ता गराएको निवेदनमा तत्कालीन प्रधानसेनापति प्याराजंग थापा, भैरवनाथ गणका तत्कालीन लेफ्टिनेन्ट कर्नेल राजु बस्नेत, मेजर विवेक विष्ट, क्याप्टेन इण्डिदवर राणा लगायत दोषी औंल्याउँदै हदैसम्मको सजाय माग गरिएको छ। सेनाले बेपत्ता पारेका पुष्पराज र धिरेन्द्र दाजुभाइ हुन्। उनीहरुका पिता भीमबहादुरले सत्य निरुपण तथा मेलमिलाप आयोगमा उजुरी दर्ता गराएका हुन्। संयुक्त राष्ट्रसंघीय मानवअधिकार उच्चायुक्तको कार्यालयले सन् २००६ मा प्रकाशित गरेको प्रतिवेदनमा धीरेन्द्र र पुष्पराज भैरवनाथ गणमै भएको उल्लेख गरेको थियो। प्रतिवेदनले भैरवनाथ गणमा थुनामा राखिएका १५ जनासँग बयानको आधारमो पुष्पराजलाई सोही स्थानमा भएको किटान गरेको थियो। 'पुष्पराज बस्नेतसँगै राखिएका विभिन्न १५ जनाव्यक्तिहरुले आयोगमा बयान गरी निज पुष्पराज बस्नेतलाई भैरवनाथगण काठमाडौंमा आफुहरुसँगै थुनामा राखिएको अवस्थामा भेटेको भनी बयान दिएको पाइयो', उच्चायुक्तको प्रतिवेदनले औंल्याएको थियो। भैरवनाथ गणमै धीरेन्द्र र पुष्पराजका आफ्नै भाइ वीरेन्द्रलाई पनि सँगै राखिएका थिए। त्यहाँ हुँदा आफ्ना भाइहरुलाई भेटेको वीरेन्द्रले बताउँदै आएका छन्। यसैगरी सोही स्थानमा सेनाले थुनेर राखेका कृष्ण केसी, बिना मगर, रमेश गुरागाइँ लगायतले बाहिर आएपछि पुष्पराजलाई प्रत्यक्ष देखेको उल्लेख गर्ने गरेका छन्।
