The National Human Rights Commission has again drawn its attention to take action against the accused of Godar incident. During an armed conflict In 2003, October 8, five youths Sanjeev Kumar Karna, Durgesh Laav, Jitendra Jha, Pramod Narayan Mandal and Shailendra Kumar Yadav were arrested by the security personnel and were disappeared. The human skeletons of all five victims were exhumed from the bank of Kamala River at Godar of Dhanusha District with the initiation of commission and were handed over to the victim’s family after scientific testing. The commission through a press release on July 22 said that it has already recommended government to take action against former CDO Rewati Raj Kafle, police sub inspector Chuda Bahadur Shrestha, former DSP Kuber Singh Rana and former Major Anup Adhikari of Dhara Pani Barrack saying that the incident was a grave human rights violation. The commission said that it is the government’s apathy on providing justice to the victim despite that the incident was proved after the scientific exhumation of skeletons of the victims. This shows the apathy of the government towards the Human Rights and providing justice to the victim by motivating impunity. The statement signed by the commission’s spokesperson Mohana Ansari says that “It is the government’s responsibility to implement the commission’s recommendations. It is one of the major parts of transitional justice to take action against the accused of grave violation of Human Rights. धनुषा जिल्लाका पाँच जना युवाहरू सञ्जीवकुमार कर्ण, दुर्गेश लाभ, जितेन्द्र झा, प्रमोदनारायण मण्डल र शैलेन्द्रकुमार यादवलाई सशस्त्र द्वन्द्वको क्रममा २०६० असोज २१ गते सुरक्षाकर्मीद्वारा गिरफ्तार गरी बेपत्ता पारेको १३ वर्षपुग्न लाग्दासमेत सो घटनाका दोषीलाई कारबाही नगरेको प्रति राष्ट्रिय मानव अधिकार अयोगले पुनः ध्यानाकर्षण भएको जनाएको छ । उक्त घटनाका सम्बन्धमा आयोगको पहलमा नेपाल प्रहरीबाट धनुषा जिल्लाको गोदारस्थित कमला नदीको किनारबाट पाँच ओटै मानव अवशेषहरू उत्खनन् गरी त्यसको वैज्ञानिक परीक्षण पश्चात मानव अवशेषहरू पीडितका आफन्तहरूलाई हस्तान्तरण गरिएको आज २ वर्षपूरा भैसकेको आयोगले जनाएको छ । आयोगले साउन ७ गते एक प्रेस विज्ञप्ति जारी गर्दै उक्त घटनालाई गम्भीर मानव अधिकार उल्लङ्घन भएको ठहर गरी धनुषा जिल्लाका तत्कालीन प्रमुख जिल्ला अधिकारी रेवतीराज काफ्ले, क्षेत्रीय प्रहरी इकाई कार्यालय धनुषाका तत्कालीन प्रहरी उपरीक्षक डा. चुडाबहादुर श्रेष्ठ, जिल्ला प्रहरी कार्यालय धनुषाका तत्कालीन डिएसपी कुवेरसिंह राना र नेपाली सेना धारापानी ब्यारेक धनुषाका तत्कालीन मेजर अनुप अधिकारीलाई कानुन बमोजिम कारबाही गर्न नेपाल सरकारलाई यस अघि नै सिफारिश गरिसकेको जनाएको छ । शव उत्खनन् पश्चात् वैज्ञानिक रूपबाट समेत पुष्टि भइसकेको घटनाका दोषीमाथि कानुनी कारबाही प्रक्रिया अझै अघि नबढाउनुले पीडितको न्याय प्राप्तिको अधिकार पूर्णतः कुण्ठित भएको आयोगको विज्ञप्तिमा जनाइएको छ । यसबाट दण्डहीनताको स्थितिले प्रोत्साहन पाउनुको साथै नेपाल सरकार मानव अधिकारको सम्मान र संरक्षण गर्ने दायित्वप्रति उदासीन भएको देखिन्छ । नेपालको संविधान तथा राष्ट्रिय मानव अधिकार आयोग ऐन एवम् सम्मानित सर्वोच्च अदालतको फैसला बमोजिम आयोगको सिफारिस कार्यान्वयन गर्नु सरकारको जिम्मेवारी हो । यस्ता गम्भीर प्रकृतिका मानव अधिकार उल्लङ्घनका दोषीलाई कारबाही गर्नु सङ्क्रमणकालीन न्यायको एउटा महत्वपूर्ण पक्ष पनि हो ।'-आयोगकी सदस्य एवम् प्रवक्ता मोहना अन्सारीद्वारा हस्ताक्षरित विज्ञप्तिमा जनाइएको छ ।
