Banke/ June 4 Family of Kranti Abhilashi Devkota of Sangam chok in Bankatawa VDC-4 has lodged a complaint against the then Captain Ramesh Swar and Major Ajit Thapa of Chisapani Barrack at Area Police Office, Kohalpur on June 2. The family filed the complaint 12 years after the murder of their son following order from the Appellate Court Nepalgunj. Police had been refusing to register the case saying that the incident happened during the armed conflict. The victim’s mother Radha Devi Devkota had tried to lodge a complaint at APO Kohalpur against the accused previously demanding action against those involved in the murder. Kranti was taken into control by the army from a hotel in Digiya Chok of Nauwasta VDC-2 on December 30, 2001 and shot dead later. The victim’s mother lodged a writ demanding mandamus at Appellate Court (AC), Nepalgunj against the police on August 14, 2012 after they refused to register the case. While hearing the writ on December 26 last year, a joint bench of chief judge of AC Keshav Prasad Mainali and judge Shiva Raj Adhikari ordered the District Police Office and the APO to register the case. The AC had send sent a letter to the police five months later on May 19 with a copy of the court verdict. Radha Devi along with human rights activists including representatives of INSEC, Advocacy Forum had reached the APO Kohalpur on May 30 demanding the complaint be registered as per the court verdict. Though the police had refused to register the case for two days saying that they had to ask the superior body, the case was registered on June 2. Earlier, four cases related to human rights violations which were initially refused by the police were registered following the Appellate Court’s order. Binod Pandey बाँके । जेठ २१ गते छोराको हत्या भएको १२ वर्षपछि पीडित परिवारले जेठ १९ गते इलाका प्रहरी कार्यालय कोहलपुर, बाँकेमा चिसापानीस्थित नेपाली सेनाको ब्यारेकमा कार्यरत तत्कालिन क्याप्टन रमेश स्वार र मेजर अजित थापाविरुद्ध जाहेरी दर्ता गराएका छन् । ०५८ सालमा भएको सो घटना द्वन्द्वकालको भन्दै प्रहरीले जाहेरी दर्ता गर्न अस्वीकार गर्दै आएकोमा पुनरावेदन अदालत नेपालगञ्जको आदेशपछि सेनाविरुद्ध कर्तव्य ज्यानको सो जाहेरी दर्ता भएको हो । नौवस्ता गाविस-२ डिगिया चोकस्थित एक होटलमा बसेका बेला ०५८ पुस १५ गते सेनाले आफ्नो नियन्त्रणमा लिई गोली हानी हत्या गरिएका बनकटवा-४ संगमचोकका २० वर्षीय क्रान्ति अभिलाषी देवकोटाकी आमा राधादेवी देवकोटाले ०६९ साउन १६ गते छोराको हत्यामा सङ्लग्नहरू उपर सजायको माग गर्दै इलाका प्रहरी कार्यालय कोहलपुरमा कर्तब्य ज्यान मुद्दाको जाहेरी दर्ता प्रयास गरेकी थिइन् । पटक पटक र्इलाका प्रहरी कार्यालय कोहलपुरमा जाँदासमेत प्रहरीले जाहेरी दर्ता नगरेपछि सरकारी मुद्दा सम्बन्धी ऐन २०४९ बमोजिम ०६९ साउन २१ गते जिल्ला प्रहरी कार्यालयमा निवेदन दर्ता गर्न गएकोमा जिल्ला प्रहरी कार्यालयले पनि द्वन्द्वकालको मुद्दा सत्य निरुपण आयोगले हेर्ने भन्दै जाहेरी दर्ता गर्न अस्वीकार गरेको थियो । प्रहरीले जाहेरी दर्ता नगरेपछि पीडित पक्षले प्रहरीका विरुद्धमा पुनरावेदन अदालत नेपालगञ्जमा ०६९ साउन ३० गते परमादेशको रिट निवेदन दायर गरेकी थिइन् । ०६९ पुस ११ गते प्रहरी विरुद्ध परेको रिटको सुनुवाई गर्दै पुनरावेदन अदालतका मुख्य न्यायाधीश केशवप्रसाद मैनाली र न्यायाधीश शिवराज अधिकारीकोको संयुक्त इजलासले जिल्ला प्रहरी कार्यालय र ईलाका प्रहरी कार्यालय कोहलपुरका नाममा जाहेरी दर्ता गर्नु भन्ने आदेश गरेको थियो । आदेश भएको झण्डै पाँच महिनापछि आदेशको प्रतिलिपि सहित जेठ ५ गते अदालतले प्रहरीलाई पत्र पठाएपछि अदालतको आदेश बमोजिम जाहेरी दर्ता गरी पाँउ भनी मृतककी आमा राधा देवी एड्भोकेसी फोरम र इन्सेक प्रतिनिधि लगायत अधिकारकर्मीसहित जेठ १६ गते इलाका प्रहरी कार्यालय कोहलपुरमा पुगेकी थिइन् । प्रहरीले पुनः द्वन्द्वकालको घटना भएकाले माथि सोध्नु पर्ने भन्दै दुई दिनसम्म जाहेरी दर्ता गर्न अस्वीकार गरेकोमा दुई दिनपछि जेठ १९ गते जाहरी दर्ता गरेको हो । प्रहरीले यसअघि पनि मानवअधिकार उल्लङ्घनसँग सम्बन्धित चार ओटा जाहेरी दर्ता गर्न नमाने पछि पुनरावेदन अदालत नेपालगञ्जको आदेशपछि मात्र जाहेरी दर्ता भएका थिए । विनोद पाण्डे
