Court Issues Mandamus on Conflict-related Extra-Judicial Killings

Bardiya, Dwandama bhayeko hatya mudha ma adalat bolyo. Bardiya/ November 7 Appellate court of Nepalgunj on November 5 has issued a mandamus against District police office of Bardiya and District administration office of Bardiya over refusal to register a case. The mandamus was issued as per the justice administration act 2048, 8(2) asking DPO Bardiya to register the case if the complainant follows due procedure to register the case or to inform the complainant in written with reason if the complaint cannot be registered. The district police office of Bardiya on October 3 had denied registering killings after abduction of Dil Bahadur Khadka, 41, and Narayan Prasad Sapkota, 39, of Kalika VDC-4 by the then rebels; Suresh Chaudhari, 25, Kanhaiya lal Tharu, 17, Karna Bahadur Tharu, 27 of Dhadhawar VDC-8, and Anil Chaudhari, 15, of Dhadhawar VDC-5 by security personnel in captivity citing insufficient proof. Following the denial, Bhagi Ram Chaudhary, chairperson of conflict victim committee, Bardiya had lodged a complaint at District administration office on October 4, 2013 on behalf of conflict victim as per the clause 3(5) of government cases act 2049 seeking mandamus against the agencies to file the cases. The writ of mandamus was lodged at appellate court Nepalgunj by the victims against the agencies on October 27. Advocate Govinda Bandi, Basanta Gautam, Laxmi Pokhrel and Kashi Ram Dhungana had argued from victim's side. We will follow the procedure to register the case at District Police Office as per the order from appellate court of Nepalgunj, said Bhagi Ram Chaudhary.
