Court Issues show cause notice over police refusal to register case

Appellate Court in Nepalgunj, on April 21, has issued a show-cause notice in the name of District Police Office, Bardiya regarding its refusal to register FIRs of murder cases. Hearing over six cases demanding mandamus registered on April 21, the court sought basis and reasons from the police office regarding its refusal to register the cases. According to advocate Basant Gautam, who pleaded on behalf of the petitioner Bhagiram Chaudhary, a bench of Judge Abadh Bihari Prasad Sinha asked DPO Bardiya and its chief to furnish reasons within 15 days on why the court should not issue the order as sought by the plaintiff. Chaudhary said that the conflict victims were compelled to register the petition as SP Govind Ram Pariyar of the DPO returned the case stating that the cases would come under the purview of the Commission of Investigation into Disappeared Persons and Truth and Reconciliation Commission, and cannot be registered as per the Government Cases Act, 2049. The conflict victims had arrived at the DPO Bardiya to register FIRs following the mandamus by Appellate Court in Nepalgunj regarding registration of the cases on November 5, 2014. The police officials had refused to register the cases stating that it would take time to study the cases. Police have been refusing to register the murder of Dil Bahadur Khadka and Narayan Prasad Sapkota of Kalika VDC-4 by the then rebels; Suresh Chaudhary, Kanhaiyalal Tharu, Karna Bahadur Tharu of Dhadhabar VDC-8, and Anil Chaudhary of Dhadhabar VDC-5 by security persons in different dates during the conflict period.
